This Privacy Policy describes how we collect, use, store, and protect information in connection with jaxcapfund.com, the JAX Capital Yield Fund I investor portal, and any related services (collectively, the "Platform").

By accessing or using the Platform, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Platform.

Information you provide directly:

  • Password hashing using bcrypt for all portal credentials
  • Access controls limiting data access to authorized personnel only

  • Regular security reviews of Platform code and infrastructure

While we take reasonable steps to protect your information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security and encourage you to use strong, unique passwords for your portal account.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this policy, including:

  • Active investor records — maintained for the duration of your investment in JAX Capital Yield Fund I
  • Post-investment records — retained for a minimum of five (5) years following the close of your investment, in compliance with SEC and IRS record-keeping requirements
  • Tax records — retained for the period required by applicable federal and state tax law (generally 7 years)
  • Accredited investor verification — retained for the applicable regulatory period

When retention periods expire and legal obligations are satisfied, we securely delete or anonymize your personal information.

Your Rights & Choices

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access — request a copy of the personal information we hold about you
  • Correction — request correction of inaccurate or incomplete information
  • Deletion — request deletion of your personal information, subject to our legal retention obligations
  • Restriction — request that we restrict processing of your data in certain circumstances
  • Portability — receive your data in a structured, machine-readable format
  • Objection — object to processing based on legitimate interests

You may opt out of non-essential email communications at any time by contacting us directly. Transactional communications related to your investment (distributions, tax documents, material updates) cannot be opted out of while you remain an investor.

The Platform uses cookies and browser local storage. The types of cookies we use include:

  • Essential Cookies — required for core site functionality such as login sessions and security
  • Performance & Analytics Cookies — help us understand how the Platform is used so we can improve it

International Transfers

JAX Capital LLC is based in the United States. If you access the Platform from outside the United States, please be aware that your personal information will be transferred to, stored, and processed in the U.S., where data protection laws may differ from those in your country of residence.

By using the Platform, you consent to the transfer of your information to the United States. We take appropriate measures to ensure that your information receives an adequate level of protection wherever it is processed.

Children's Privacy

The Platform is intended solely for accredited investors who are at least 18 years of age. We do not knowingly collect personal information from individuals under 18. If we become aware that a minor has provided us with personal information, we will delete it promptly.

Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or the Platform. When we make material changes, we will update the "Last Updated" date at the top of this page and notify active investors by email.

Your continued use of the Platform after any changes constitutes acceptance of the updated policy.
